The department is staffed by two full time magistrates, two full time bailiffs, and one assignment coordinator. The Magistrateâ€™s Office is divided into two sections: criminal/traffic and civil. The criminal/traffic section handles the arraignments for traffic and criminal matters where the defendants are not incarcerated, most minor misdemeanor traffic and criminal trials, and protection order hearings. Through the rich history of Dayton Municipal Court, the court has endeavored to continually exhibit initiative and creativity to become a front runner regarding new technology, community sanctions and programming between the Court and the community agency service providers for the rehabilitation of offenders. The Dayton Municipal Court Probation Department continues to provide a multitude of services and programs to the judiciary of the Court. Upon referral to Dayton Municipal Probation Department for pre-sentence investigations, extensive investigative reports providing pertinent information regarding the offendersâ€™ involvement in the offense, along with vital social/background data, are presented to the Judges once guilt has been established. Included in this report is any information gathered from the victim via compliant feedback, a substance abuse assessment and a psychological evaluation if necessary. This broad and complete compilation of information assures the judiciary that the sanction rendered by them is relative to the offender. Those offenders placed on supervised probation are informed of the conditions of their probation and ordered to meet regularly with their probation officer. By providing an intensive, ongoing review of a case by the judge, special programming and intensive sanctions are imposed upon a defendant who may benefit from, a nontraditional, rehabilitative effort over a period of time. The special dockets have proven effective for a number of individuals while at the same time ensuring public safety in the community. Since 1999 the Dayton Municipal Court has established, by local rule, four special dockets. The four dockets are the Mental Health Docket, Recovery Now Docket, Safe Neighborhoods Docket and Housing Court Docket. Access ii - Mental Health Court Docket In, 2003 Judge John S. Pickrel convened the first Dayton Municipal Mental Health Docket and reviewed two candidates for potential entry into the Access II Program. The Access II Program is designed to meet the needs of persons with mental health problems charged with misdemeanors in the city of Dayton. These individuals must be stable enough to understand and comply with program requirements. Access II candidates are referred by Dayton Police Department officers trained in crisis intervention. Additionally, individuals are referred by the City Prosecutorâ€™s Office, Public Defender, Crisis Care specialists at the Montgomery County Jail, and a licensed social worker from Day-Mont Behavioral Healthcare. These proceedings are cases not officially assigned to each judgeâ€™s docket, but must be handled in the course of regular, daily court business. Criminal, traffic and civil cases that are officially assigned to each judge result in a yearly annual average of 1,462 guilty pleas at the pretrial or trial stage, 784 dismissals or other terminations, 398 failure to appear warrants, and 94 trials both by the court or jury. Beyond these reported activities, judges hear default civil cases and preside over probation hearings, motions to suppress, and hundreds of other issues raised by written motions. In addition to time spent in court, each judge must schedule office meetings, conference calls with attorneys and conduct legal research necessary for decisions. The demands of public appearances and service on numerous community and criminal justice boards must also be scheduled into the judgeâ€™s calendar. The Dayton Municipal Court was created in 1913 by the Ohio State Legislature and began its judicial operation in 1914. Established administrative functions and legal processes insure that municipal court case documentation is recorded and maintained appropriately for the public record. Clerk of Court Table of Organization The Clerk of Courtâ€™s Office is divided into four divisions: Civil, Central Payments, Traffic, and Criminal. The Civil Division is comprised of the General Division, Small Claims, Rent Escrow, and Trusteeships. The General Division annually processes over 10,000 civil suits initiated by attorneys. In addition, the division processes nearly 25,000 wage and bank attachments, 2,000 foreign certificate of judgment transfers, and over 1,000 small claim cases annually. The office records all case document filings and receipts and then disburses funds according to the orders and directives of the court. In 2007 the Civil Division disbursed more than 5.6 million dollars.
