RULES OF PRACTICE

EFFECTIVE AUGUST 1, 1998,
WITH REVISIONS CURRENT THROUGH JANUARY 1, 2007

The following rules have been adopted by the Municipal Court of Dayton, Ohio for the purpose of promoting the administration of justice by conforming this court's rules with the uniform rules of practice and superintendence in effect in the State of Ohio.

The Rules shall be applied, construed, and enforced so as to avoid inconsistency with other rules of court and statutes governing proceedings, functions, and services of this court. In their application and administration, they shall be construed and employed so as to provide fairness and simplicity in procedure, to avoid technical and unjustifiable delay, and to secure just, expeditious, and inexpensive determinations of all actions and proceedings.

THESE RULES SUPERSEDE ALL PREVIOUS RULES ADOPTED BY ANY JUDGE OR JUDGES OF THE DAYTON MUNICIPAL COURT.

CITATION OF RULES

These rules shall be known as the Dayton Municipal Court Rules of Practice and may be cited as DMCR _______.

SESSIONS AND TERM OF COURT

  1. The general business hours of the court are Monday through Friday, 8:00 A.M. to 4:30 P.M.
  2. The sessions of the court shall be as follows: Traffic Court shall be at 8:30 A.M. Monday through Friday. All other sessions of the Dayton Municipal Court shall be from 9:00 A.M. until 12:00 noon and from 1:30 P.M. to 4:30 P.M. on each day except Saturday, Sunday, legal holidays, and as otherwise ordered by the court.
  3. There shall be no term in Municipal Court, but for the purpose of computing time ninety (90) days following judgment shall be considered within term and time thereafter shall be considered after term.
  4. No session is held on a day when weather or other causes require the court to be closed as determined by the Administrative Judge.
